Defective hernia mesh injury: is it compensable?

According to statistics, one of the most common surgeries performed in the world are hernia repair surgeries. The United States Food and Drug Administration says that an estimated 2.3 million inpatient abdominal hernia repairs were performed from 2001 to 2010, of which an estimated 567,000 were performed in emergency.

Additionally, some small hernias at the belly button can be repaired with suture alone. Most repairs, though, do utilize prosthetic mesh to achieve a successful repair.

Owing to the increase in the number of hernia mesh repair surgeries being performed, the number of defective mesh repair injuries also increased. There are many factors contributing to the rise in the number of faulty hernia repair surgeries.

It may be due to medical malpractice, unforeseen complications, or defective mesh products. The US-FDA said that many of the reported complications associated with hernia mesh repair surgeries are due to the usage of recalled mesh products.

Although not all symptoms of a failed mesh repair surgery are visible, there are some which are readily noticeable. Some of the telltale signs of failed mesh repair surgeries are: high fever, bloating, redness at the surgery site, appearance of abscess, recurrent hernias, bowel obstruction and even erectile dysfunction.
